Nothing in these Terms affects your statutory rights as a consumer.

Scent Reminiscent offers this website, including information, tools, products and services available from this site, subject to your acceptance of these Terms and any linked policies.

These Terms apply to all users of the site, including browsers, customers, account holders and contributors of content.

By using any part of the website or placing an order, you agree to these Terms. If you do not agree, you should not use the website or place an order.

Any new features, products, services or tools added to the store shall also be subject to these Terms unless stated otherwise.

3. Online Store Terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your country of residence, or that you are the age of majority and have given consent for any minor dependants to use this site.

You may not use our products, website or services for any illegal or unauthorised purpose. You must not violate any applicable laws, including intellectual property, consumer protection, customs, import/export, product safety, data protection or online conduct laws.

4. Products, Product Descriptions and Availability

Certain products may be available exclusively online and may have limited quantities. Products are subject to return, cancellation or exchange only in accordance with these Terms, our Returns & Refunds Policy and your statutory rights.

We make reasonable efforts to display colours, images, condition, packaging, bottle presentation and product details accurately. We cannot guarantee that your device display will show colours exactly as they appear in person.

Many of our products are rare, discontinued, vintage, older formulation, earlier packaging, pre-reformulation, partial, tester, sample, miniature, decanted or otherwise limited-availability items. Product listings should be read carefully and all photographs should be reviewed before purchase.

Where a listing uses wording such as “sold as seen”, “vintage”, “older packaging”, “earlier formula”, “pre-reformulation”, “discontinued”, “tester”, “sample”, “miniature”, “partial”, “sealed”, “unsealed”, “boxed”, “unboxed”, “damaged box”, “no box” or similar wording, that description forms part of the product condition and purchase information.

Unless a listing clearly states otherwise, accessories, outer sleeves, cellophane, batch code cards, gift boxes, display stands or other extras are not included. Customers should rely on the written description and photographs for the exact item being sold.

We reserve the right to limit sales, cancel suspicious orders, restrict quantities, discontinue products or refuse orders where lawful, including where an item is unavailable, restricted for shipping, affected by an error or suspected to be purchased fraudulently.

We do not warrant that the scent, longevity, projection, colour, packaging condition, age-related condition, collectability or subjective performance of any product will meet your personal expectations, except where the product is faulty, not as described or where statutory rights apply.

5. Independent Reseller Disclaimer

Scent Reminiscent is an independent reseller of genuine fragrances. We are not affiliated with, endorsed by, sponsored by, authorised by, approved by or officially connected with any fragrance brand, designer, manufacturer, distributor, trade mark owner or copyright owner unless expressly stated otherwise in writing.

All brand names, fragrance names, logos, bottle designs, packaging images, house marks, trade dress, copyrighted materials and trade marks remain the property of their respective owners. These names and marks are used only for identification, description, comparison, resale and truthful reference to genuine products.

The use of any brand name or fragrance name on our website does not imply any association, sponsorship, endorsement, approval, licence or commercial relationship between Scent Reminiscent and the relevant brand owner.

Product images are used to help customers identify the fragrance, bottle, box, presentation, version, size, concentration, batch, age, condition or packaging being sold. Unless otherwise stated, Scent Reminiscent does not claim that any brand owner has authorised, approved or endorsed our resale activities.

Products may be sold as genuine resale goods, vintage goods, discontinued goods, collectors items, second-hand goods, surplus stock, business clearance stock, old stock, dead stock, auction stock, private collection stock or independently decanted goods, depending on the relevant product listing.

6. Sourcing, Authenticity and Lawful Supply

We take authenticity seriously and aim to source products lawfully from legitimate and reputable channels.

Our sourcing channels may include authorised retailers, department stores, perfumeries, distributors, auctions, business clearances, old stock suppliers, private collections, collectors, estate sales and other lawful sources.

Some products may come from older, discontinued, rare or dead stock. Such items may be genuine but may also show signs of age, storage history, evaporation, box wear, label wear, packaging changes, formulation differences, reformulation differences or other age-related characteristics.

Where applicable, product listings, descriptions, photographs, labels, batch codes, packaging details and condition notes are provided to help customers assess the item before purchase.

Scent Reminiscent does not claim to be an authorised distributor, official stockist, approved reseller or brand representative for any fragrance brand unless expressly stated.

If we have any reason to believe a product is not genuine, we will not knowingly offer it for sale. If a genuine concern is raised after purchase, we will review the matter carefully in line with our legal obligations and customer service procedures.

7. Decants, Samples and Hand-Decanted Products

Where a product is described as a decant, sample, hand-decanted fragrance, atomiser, vial, travel spray or similar, it is not supplied in the original manufacturer retail bottle unless expressly stated in the product listing.

A decant is prepared by transferring fragrance from a genuine original bottle into an unbranded atomiser, vial or sample container. Decants are prepared independently by Scent Reminiscent and are not produced, authorised, sponsored, approved or endorsed by the original fragrance brand or manufacturer.

Brand and fragrance names are used only to identify the genuine fragrance from which the decant has been prepared. Customers should not expect original retail packaging, original branded atomisers, manufacturer presentation, sealed branded packaging, batch-matched retail cartons or brand-issued samples unless clearly stated in the product listing.

The fill size of a decant or sample will be stated in the product listing. Due to small-volume filling, there may be minor visual variation in headspace, atomiser style, vial shape or label placement. This does not necessarily indicate a shortage, defect or authenticity issue.

Decants and samples are intended to help customers experience a fragrance before buying a full bottle, or to access rare, discontinued or expensive fragrances in smaller quantities. They are not manufacturer samples and should not be represented by customers as manufacturer-produced samples.

Decants, samples, sample sets and hand-decanted fragrances may be prepared specifically for the customer after an order is placed. Because these items are made to order and supplied for personal use, we do not accept change-of-mind returns for decants, samples, sample sets or hand-decanted fragrances once the order has been prepared, fulfilled or dispatched, unless the item is faulty, damaged, incorrect, not as described or statutory rights require otherwise.

For safety and product integrity, customers should store decants upright, tightly closed and away from heat, direct sunlight, children, pets and ignition sources.

8. Vintage, Discontinued and Older Fragrances

Vintage, discontinued, older formula and older packaging fragrances can differ from contemporary retail products. By purchasing these items, you acknowledge that they may have age-related characteristics and that scent perception is subjective.

Colour changes: fragrances may darken, lighten or change colour over time due to natural ageing and ingredient interactions.

Evaporation: some evaporation may occur over time, especially in older bottles, splash bottles, imperfect seals or long-stored stock.

Top notes: the most volatile notes may soften, fade, shift or dissipate with age. Middle and base notes may be more stable but can also evolve.

Fragrance changes: the smell may differ from a freshly manufactured bottle, a current formulation or a customer personal memory of the fragrance.

Storage history: although we store our stock with reasonable care, typically away from excessive heat and light, we cannot guarantee how products were stored before we acquired them.

Packaging condition: boxes, labels, cellophane, caps, seals and bottles may show age-related wear, marks, dents, fading, staining, scratches, oxidation or other cosmetic changes.

Rarity and availability: vintage and discontinued products are often limited in supply. Once sold, the same item, batch, size or presentation may not be available again.

Where a product is sold sealed, we may not be able to inspect the liquid, sprayer, stopper, scent, exact fill level or internal condition without opening it. Customers purchasing sealed vintage products accept the particular risks associated with sealed aged fragrance goods.

By proceeding with the purchase of a vintage, discontinued, rare, earlier formula, older packaging or pre-reformulation fragrance, you confirm that you understand and accept the unique qualities, uncertainties and age-related risks associated with such products.

9. Customer Responsibility Before Purchase

Customers are responsible for reading the full product description, reviewing all photographs carefully, checking size, concentration, condition, packaging, decant/sample status, shipping restrictions and any specific listing notes before placing an order.

For vintage, rare, discontinued, partial, boxed, unboxed, sealed, unsealed, tester, sample, miniature, decant and collectors items, photographs form an important part of the description. If you are unsure about any aspect of an item, please contact us before purchasing.

Product listings may include the wording: “SOLD AS SEEN. PLEASE REVIEW ALL PHOTOS CAREFULLY AND FEEL FREE TO ASK ANY QUESTIONS BEFORE PURCHASE.” This wording does not remove or reduce your statutory rights. It reminds customers that many products are rare, vintage, discontinued or condition-specific items where photographs and descriptions are important.

10. Payment, Order Acceptance and Contract Formation

When you place an order through our website, you are making an offer to purchase the selected product or products in accordance with these Terms.

An order confirmation email acknowledges that we have received your order. It does not necessarily mean your order has been accepted if there is a pricing error, stock issue, payment issue, fraud concern, shipping restriction or other lawful reason preventing fulfilment.

A contract is formed when we accept and dispatch your order, or otherwise confirm acceptance.

We reserve the right to cancel and refund an order before dispatch if the item is unavailable, incorrectly priced, restricted for shipping, suspected to be purchased fraudulently, or affected by an obvious error.

Payment processing is handled by third-party payment providers. We do not store full payment card details on our website. Payment providers may have their own terms, privacy notices and security procedures.

11. Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases made through our store.

You agree to promptly update your account and other information, including your email address, billing address, delivery address and payment details, so that we can complete your transactions and contact you as needed.

We may refuse, limit or cancel orders where lawful, including orders that appear to be placed for unlawful, suspicious, fraudulent, abusive or resale-manipulation purposes.

12. Prices, Errors and Availability

Prices for our products are subject to change without notice.

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, offers, shipping charges, transit times, availability, condition, age, size, concentration or other details.

We reserve the right to correct errors, inaccuracies or omissions, and to change or update information or cancel orders if information on the website is inaccurate at any time, including after you have submitted your order.

We undertake no obligation to update, amend or clarify information except where required by law.

13. Shipping, Delivery and Fragrance Restrictions

We will provide shipping options and estimated delivery times at checkout where available. Delivery times are estimates and are not guaranteed unless expressly stated.

Fragrances, perfumes, aftershaves, extrait, eau de parfum, eau de toilette, cologne, oils, decants and other scented liquids may be subject to postal, courier, airline, dangerous goods, flammable liquid and customs restrictions. These restrictions may affect available shipping methods, destinations, packaging requirements, transit times and whether certain items can be shipped at all.

We reserve the right to refuse, cancel or amend an order if we cannot lawfully or safely ship the product to the destination provided. If this happens, we will contact you and, where appropriate, provide a refund for any unavailable or undeliverable item.

Customers are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed deliveries, customs holds, returned parcels or additional charges caused by incorrect or incomplete delivery information supplied by the customer.

Where international shipping is offered, the customer may be responsible for customs duties, taxes, import VAT, brokerage charges, local handling fees and compliance with local laws. We are not responsible for products being delayed, refused, seized or returned by customs or local authorities due to restrictions outside our control.

14. Returns, Cancellations and Refunds

This section applies to purchases made online through our website and should be read together with our separate Returns & Refunds Policy in Part B of this document. Nothing in these Terms affects your statutory rights.

For most online orders, customers have the right to cancel within 14 days after receiving the goods. After notifying us of cancellation, customers generally have a further 14 days to return the goods. Refunds will be processed in accordance with applicable consumer law after we receive the returned goods or evidence that they have been sent back, where applicable.

To cancel an order or request a return, customers should contact us at Hello@ScentReminiscent.com with their order number, name, email address and reason for contact. We may provide return instructions, including the return address and any packaging requirements.

Returned products must be sent back in the same condition in which they were received. Where an item is sealed, boxed, unused, unopened, supplied with protective packaging, or sold as a condition-specific collectible item, it should be returned unopened, unused, unaltered and with packaging intact where possible.

For hygiene, safety, authenticity, product integrity and resale reasons, we may be unable to accept returns of opened, used, sprayed, tampered-with, altered, damaged, contaminated or materially changed fragrance products unless the item is faulty, damaged, not as described or statutory rights require otherwise.

Decants, samples, sample sets, and hand-decanted fragrances may be prepared specifically for the customer after an order is placed. Because these items are made to order and supplied for personal use, we do not accept change-of-mind returns, cancellations, exchanges or refunds for decants, samples, sample sets or hand-decanted fragrances once the order has been prepared, fulfilled or dispatched.

This does not affect your statutory rights. If a decant, sample, sample set or hand-decanted fragrance arrives damaged, leaking, incorrect, materially different from the product ordered, or faulty, please contact us promptly at Hello@ScentReminiscent.com with your order number and clear photographs of the issue.

For the avoidance of doubt, a fragrance will not be treated as “not as described” simply because the customer does not like the scent, expected a different scent profile, expected better longevity or projection, dislikes how it smells on their skin, or has compared it subjectively with another bottle, memory, batch or formulation.

Customers may be responsible for the cost of returning unwanted items unless the item is faulty, damaged, not as described, or we have agreed otherwise. Returned items should be packaged securely. We recommend using a tracked or insured service for valuable items.

If a product is faulty, damaged in transit, materially not as described or incorrect, customers should contact us as soon as reasonably possible with their order details and clear photographs where relevant. We will review the matter and provide an appropriate remedy in accordance with statutory rights.

We reserve the right to make a reasonable deduction from a refund where the value of goods has been reduced by handling beyond what is necessary to inspect them, where permitted by law.

15. Allergies, Sensitivities and Safe Use

Fragrances may contain allergens, alcohol, essential oils, aroma chemicals, colourants, solvents and other ingredients that can cause irritation or sensitivity in some individuals. Customers are responsible for checking ingredient information where available and for using fragrance products safely.

Do not use fragrance products on broken, irritated or sensitive skin. Discontinue use if irritation occurs. Keep away from eyes, children, pets, flames, heat sources and polished or delicate surfaces. Fragrances are flammable and should be stored responsibly.

Vintage and older fragrances may not carry current allergen, CLP or ingredient labelling in the same way as contemporary retail products. If you have allergies, sensitivities, asthma or other concerns, please contact us before purchasing and consider avoiding vintage or unboxed products where ingredient information cannot be confirmed.

16. Optional Tools, Third-Party Services and Links

We may provide access to third-party tools or services over which we do not have full control. These may include payment processors, delivery services, review tools, analytics tools, email tools, marketing tools, security tools, social media integrations and WooCommerce extensions.

Access to such tools is provided “as is” and “as available” except where required by law. Any use of optional third-party tools is at your own risk and discretion.

Third-party links may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating the content, accuracy, policies or practices of third-party websites. Complaints or questions regarding third-party products or services should be directed to the relevant third party.

To the fullest extent permitted by law, Scent Reminiscent and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors shall not be liable for indirect, incidental, punitive, special or consequential damages, loss of profit, loss of revenue, loss of savings, loss of data or replacement costs arising from your use of the Service or any product purchased through the Service.

21. Events Outside Our Control

We are not responsible for any failure or delay in performing our obligations where such failure or delay is caused by events outside our reasonable control, including postal disruption, courier disruption, customs delays, strikes, transport disruption, severe weather, fire, flood, internet outages, payment provider issues, supplier issues, changes in law, regulatory restrictions or other events beyond our reasonable control.
